Please read these Terms of Service carefully before using Gearloop. By accessing or using Gearloop, you agree to be bound by these Terms. If you do not agree, you may not access or use the Service. 1 - Interpretation and Definitions 1.1 - Interpretation
The words with initial capital letters have meanings defined under the following conditions. The following definitions apply equally whether they appear in singular or plural. 1.2 - Definitions
Account means a unique account created for You to access our Service.
- Buyer means a user placing Orders for Goods.
- Seller means a user listing Goods for sale.
- Trader means a Seller acting in the course of business (subject to the Consumer Rights Act 2015).
- Private Seller means a Seller acting in a private capacity (consumer rights do not apply in the same way).
- Order means a request to purchase Goods on the Service.
- Content means any text, images, or material uploaded by You.
- Service means the Gearloop website (gearloop.org.uk) and related services.
- You means the individual accessing the Service, or the company or other legal entity represented by such individual.

3 - Acknowledgement These Terms govern the use of Gearloop and form the agreement between You and Gearloop. Your access to and use of the Service is conditioned on Your acceptance of and compliance with these Terms. You represent that You are over 16years of age. Use of the Service is also subject to our Privacy Policy, which explains how we handle your data under UK GDPR.
4 - Governing Law These Terms are governed by the laws of England and Wales. If You are a consumer resident in another European Union country, You will also benefit from any mandatory provisions of local law.
5 - User Accounts When You create an Account with us, You must provide accurate and complete information. You are responsible for safeguarding Your password and for all activities that occur under Your Account. You must notify us immediately of any unauthorised use of Your Account. We may suspend or terminate Your Account if You breach these Terms. You may close Your Account at any time by contacting us or through the Service.
6 - Content You are responsible for the Content You post. By uploading Content, You grant Gearloop a licence to use and display it for the purposes of operating the Service. You must not post unlawful, offensive, infringing, or misleading Content. We may remove Content that breaches these Terms.
7 - Prohibited Goods Sellers may not list goods that are illegal, stolen, counterfeit, unsafe, or otherwise prohibited. This includes (but is not limited to): weapons, ammunition, explosives, medicines, supplements, consumables, and any items that do not meet UK safety standards. Additional prohibited goods include:
- Items infringing intellectual property rights (counterfeit or unlicensed branded goods).
- Items recalled by manufacturers or regulators.
- Live animals, food, and perishable goods.
8 - Orders and Payments By placing an Order, Buyers agree to purchase goods from Sellers. A binding contract is formed directly between Buyer and Seller at the time of Order confirmation. Gearloop is not a party to this contract.
Payments are processed securely by Stripe, subject to their own terms. Gearloop does not store card details. Sellers authorise Stripe to release funds, less service fees, once Orders are completed.
9 - Fees Gearloop charges a service 5% seller fee on each transaction. The applicable fee is shown at checkout and is deducted from Seller payouts. We also charge a 5% buyer fee which is added to the total cost of the transaction. We may change our fees without notice. Sellers are solely responsible for determining, collecting, reporting, and paying any applicable taxes, including VAT, arising from their sales on Gearloop. Gearloop does not provide tax advice and is not responsible for ensuring Sellers’ compliance with UK tax law.
10 - Cancellations, Refunds, and Buyer Protection Private Sellers: Sales by private individuals are generally 'sold as seen' and do not carry statutory return rights. However, Sellers must not misrepresent goods and remain responsible for ensuring they have legal ownership and the right to sell.
Traders: Sales by Sellers acting in the course of business are subject to the Consumer Rights Act 2015 and the Consumer Contracts Regulations 2013. This means goods must be as described, of satisfactory quality, and fit for purpose. Buyers are entitled to a 14‑day right to cancel most distance purchases and obtain a full refund.
If goods are not delivered, materially differ from the description, or are counterfeit, Buyers may be entitled to a refund. Gearloop may withhold or reverse payments if fraud or non‑delivery is suspected.
11 - Disputes Buyers and Sellers should first attempt to resolve disputes directly. If this is not possible, Gearloop may offer mediation. Nothing in these Terms limits a user’s right to pursue a claim in the UK small claims court.
If Gearloop is asked to mediate, our decision regarding platform payouts (including refunds or release of funds) will be final. This does not affect either party’s right to pursue legal remedies through the UK courts.
12 - Limitation of Liability Gearloop provides the Service 'as is'. We make no warranties that the Service will be error-free or uninterrupted. To the fullest extent permitted by law, our liability is limited to the greater of: (a) the total service fees paid by You in the 12 months before the claim, or (b) £100.
13 - Intellectual Property The Service, including its design and branding, remains the property of Gearloop. Our trade marks and trade dress may not be used without our prior written consent.
14 - Changes to Terms We may modify these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance of the new Terms.
